Terms & Conditions of Service
INTRODUCTION - The following are the terms and conditions of service representing the basis upon which driving lessons are offered to you, the Trainee, by David Staynings - Driver Training. Please note that the contract for service is between you, the Trainee and David Staynings - Driver Training who are bound by the following;
1. GENERAL CONDUCT - David Staynings - Driver Training is bound by a professional code of conduct and will be courteous, polite, tidy and punctual. They will also behave in a professional and ethical manner at all times, and will try to avoid any physical contact, with the exception of course, of any emergency or in the normal course of greeting. The tuition vehicle will be fitted with dual-controls as part of the standard equipment and will be well maintained, clean and tidy. The cars will of course be fully insured for driving tuition. The instructor will not smoke in the car whilst giving tuition, nor will they use the lesson time for any other form of business, personal or otherwise.
2. SUPERVISION - Instructors will make their services available for the sole purpose of providing driving tuition at the rate per hour from time to time agreed and as shown on the current price list.
3. DRIVING LICENCE & EYESIGHT - Trainees’ MUST be in possession of a current, valid driving licence (provisional or full), which must be produced on, or in advance of the first lesson. Trainees’ must also ensure that they are able to read a vehicle registration plate, in good daylight and at a minimum distance of 20.5 metres (67 feet or about 5 car lengths) with glasses, or contact lenses if normally worn.
4. TUITION PERIODS - Appointments will normally be 120 minutes in total and on a one-to-one basis, with the exception of classroom training and Intensive courses, or where otherwise agreed. Reduced lesson times can be provided after agreement between the two parties.
5. QUALIFICATIONS - As a minimum David Staynings - Driver Training will be fully licensed (not a trainee instructor) by the (DSA) Driving Standards Agency to give driving tuition.
6. PAYMENTS - All payments for tuition must be made at least two workings days prior to the commencement of any agreed lesson and done via the TotalDrive app (details will be forwarded to the trainee by David Staynings - Driver Training after verbal agreement of start date)
7. CANCELLATIONS & POSTPONEMENTS - All cancellations must be made direct to the Instructor and MUST be made at least 48 hours in advance. If this is not possible the full training fee for the period in question may, at the sole discretion of the Instructor, be forfeited or charged. Instructors reserve the right to cancel lessons if they feel that the weather or road conditions are unsuitable or dangerous. Instructors cannot be held responsible for any costs incurred as a result of this.
8. PUNCTUALITY & NON-ATTENDANCE - Trainees’ are respectfully advised to be punctual for their appointments which will be recorded and checked by their Instructor. Where practically possible, Instructors will wait and depart after a maximum of 15 minutes, then the lesson will be terminated and the full fee in respect of that appointment may be forfeited or charged. A reciprocal waiting time may become necessary by the Trainee if their Instructor is delayed due to any unforeseen circumstances. Any lesson time lost as a result of this will always be made up by Instructors either at the end of the normal lesson time or at a later date.
9. DRIVING UNDER THE INFLUENCE - To ensure the safety of you, your instructor and other road users your instructor reserves the right to cancel any lesson if you are, or if they suspect you are, under the influence of drugs and/or alcohol or if you appear extremely tired. Should this occur the full training fee for the appointment will be forfeited or charged. We reserve the right to refuse future tuition in these circumstances.
10. THE PRACTICAL DRIVING TEST
a) Bookings - Driving tests must be booked by the Trainee. Driving test bookings always take priority over other lessons and therefore,
lessons may be postponed to allow for someone else’s driving test and vice-versa. Changes to lesson bookings as a result of this will be notified immediately and with reasonable notice. All test appointments must be notified to your Instructor as soon as they are known; otherwise they cannot guarantee to provide a vehicle for the practical driving test. Instructors cannot be held responsible for driving tests which have been double-booked.
b) Use of the vehicle - In the interests of customer and public safety Instructors reserve the right to withhold the use of a car for the test if, in their opinion, the Trainees’ driving is actually or potentially dangerous or if, under the opinion of the instructor, they are not ready for their practical test.
c) Test cancellations - Three clear working days’ notice of cancellation or postponement is required by the DSA. Failure to provide the required notice will result in the loss of your test fee. Instructors cannot be held responsible for any postponement or cancellation of tests by you or the DSA. However, they will do all that is possible to arrange another test as quickly as possible and to help you to reclaim expenses from the DSA.
11. COMPLAINTS - In the unlikely event of any complaint Trainees’ are respectfully advised to try and resolve the matter with their Instructor. If the problem cannot be resolved however, please write to; David Staynings - Driver Training, 9 Le Marechal Avenue, Southampton, Hampshire, SO318LW or dave.staynings@outlook.com at the earliest opportunity so that matters arising can be dealt with accordingly. Trainees’ statutory rights will not be affected.
12. STATUTORY RIGHTS - Nothing in these terms and conditions of service will reduce your statutory rights relating to faulty goods or services provided. David Staynings - Driver Training has a statutory obligation to provide goods & services fit for the purpose for which they were bought and as described. Similarly, any goods supplied by David Staynings - Driver Training must also be fit for the purpose for which they were bought and as described. If you have any doubts about your statutory rights please contact your local Trading Standards Department or Citizen Advice Bureau.
13. The Trainee acknowledges that David Staynings - Driver Training accepts no responsibility whatsoever for jewellery, clothing, cash or any other property which may have been left in the driving school’s vehicle.
